1. Purpose
Shop Small Boulder is a community platform that promotes local businesses offering promotions and pledging to donate a portion of sales to approved local food banks. Participants use the Site to submit business listings, promote offers, and uphold their donation commitments.
2. Eligibility
To participate, you must:

Agree to the pledge to donate at least the minimum required amount per qualifying sale to designated local food banks.
We reserve the right to verify eligibility and deny participation at our discretion.
3. Business Listings and Content
By submitting a listing, you agree that:

All information provided (including business name, contact information, and promotional details) is accurate and up to date.

You have the rights or necessary permissions to use any text, images, or materials included in your listing.

Listings may be edited, formatted, or removed by Shop Small Boulder for clarity, consistency, or compliance with these Terms.
You retain ownership of your content but grant Shop Small Boulder a non-exclusive, royalty-free license to display, distribute, and promote your listing on the Site and related marketing channels.
4. Donation Commitment
By joining the platform, you pledge to donate a minimum of $2 per sale made using your Shop Small Boulder promotion or code to an approved local food bank.
You agree to:

Accurately track sales associated with your promotion.

Submit donation payments promptly after the promotional period ends.

Provide verification or documentation of donations upon reasonable request.
Failure to honor donation commitments may result in suspension or removal from the platform.
5. Fees
There is currently no fee to participate in Shop Small Boulder. We reserve the right to introduce fees in the future with prior written notice.
6. Prohibited Conduct
Participants may not:

Post false, misleading, or inappropriate content.

Use the platform for illegal or unethical purposes.

Misrepresent the nature or amount of pledged donations.

Attempt to interfere with the functionality or security of the Site.
7. Limitation of Liability
Shop Small Boulder provides the Site and program on an “as is” basis. We do not guarantee any specific level of exposure, traffic, or sales resulting from participation.
To the fullest extent permitted by law, Shop Small Boulder, its affiliates, and representatives shall not be liable for any indirect, incidental, or consequential damages arising from participation in the program or use of the Site.
8. Indemnification
You agree to indemnify and hold harmless Shop Small Boulder, its affiliates, and representatives from any claims, damages, or expenses arising out of your participation, including but not limited to misrepresentations, intellectual property infringement, or failure to fulfill donation commitments.
9. Termination
Shop Small Boulder reserves the right to suspend or terminate your participation or remove your listing at any time for violation of these Terms or actions inconsistent with the mission of the platform.
10. Modifications
We may update or modify these Terms from time to time. Continued participation following such changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
